Important information about new regulations regarding construction field:

At the Government Meeting at the Government of Georgia on 26th of November, 2017, the Ordinance # 439 was approved and entered into force by the Technical Regulations – “Methodology of Determining Adequacy of Cost Production Cost Estimation of Construction Work”.

In accordance with the interests of the Association and the interests of the Member Companies, the Association continually prepares proposals based on the problematic issues for the members, and submits them to the relevant government agencies for further implementation.
Development of the above-mentioned Rules of Procedure was initiated by the Association, based on the existing problems provided by the Member Companies. Methods for drawing up a document confirming the pricing formula (due to the lack of relevant regulations) did not cover the possibility of the performance of the project and in most cases, based on conditional considerations, constituted a significant obstacle to the qualified construction company at the stage of submission of tender proposals for the bid they were competing with the competitive price in the tender process.
Companies that artificially invested in tender price in the absence of appropriate material-technical, human and financial resources will be able to confirm the objective realization.
It is quite simple to get such a conclusion from the present practice, and only formal in nature. This resolution is important for suppliers as well as procurers because in the absence of regulation, completion of the project was at risk of timely and high-quality performance. Given the above, the Association has raised the issue in the relevant state structures and a year ago, t a working group was formed that has begun to work on the above-mentioned Technical Rules.
Together with the Association working in this group were, the Association of State Procurement Agency, Ministry of Economy and Sustainable Development and representatives of the expert organization Optimal Group +;
The comments of other, accredited expert agencies were also taken into consideration. As a result, the Ministry of Regional Development and Infrastructure, which after the Chancellery of the Government continued to coordinate the working group, presented the regulations and concerns of business representatives to the government; It was followed by the final project development which the government approved on 26 September 2017.
